I am not sure I make sense of it.
Other articles seemed to confirm that the penalty is 2-5 years in jail.

This might be clearer.

This seems to indicate a shorter penalty.
Canadian law does not always make sense.

I don't think there are a lot of convictions for animal cruelty. 
She may be charged for what she did to her dog, but I wonder if it will go to trial. If it does will she be convicted.
If she is convicted, will she actually face jail time.
