Family dog lucky to be alive after it was snared in a trap

A family in Newfoundland is lucky their dog is alive. They were out for a walk. The dogs were running off leash when one of them began screaming. 
She had the steel bars of a Conibear Trap across her neck. The owner got injured, but he was able to free the dog in time.
There was nothing to indicate the trap was there or to warn of traps in the area.
It was just there where anyone could step on it.

Traps like that are cruel. Anything could have been caught in the trap. A wild animal would have died slowly, struggling to get free.
Any pet could have been trapped. It was lucky this time the owners were nearby. It could easily have been a person out walking. 
Who knows how often such traps are checked. It is irresponsible to just leave a trap out there where it could harm anyone.
Why is this not illegal. If it is illegal, why are they not searching for whoever did it.
Why are they still selling cruel traps like this.
